Terms of Service

These Terms of Service ("Terms") govern your access to and use of NILO.Africa (the "Platform"), operated by MaxCore Industrial Technologies (Pty) Ltd, a company registered in South Africa ("NILO.Africa", "we", "us"). By creating an account or using the Platform, you agree to these Terms.
1. What NILO.Africa is
NILO.Africa is a marketplace that connects independent sellers ("Sellers") with buyers ("Buyers") across African countries. We are an intermediary: NILO.Africa is not the seller of products listed on the Platform, does not manufacture or own the inventory, and is not a party to the contract of sale between a Buyer and a Seller unless explicitly stated otherwise.
2. Accounts
You must provide accurate information when registering and keep your login credentials confidential. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
3. Sellers
Sellers must complete our verification process before listing products. Sellers are solely responsible for the accuracy of their listings, the quality and legality of the products sold, compliance with applicable laws in their country and the destination country of the Buyer, and fulfilling orders in a timely manner. NILO.Africa charges a commission on completed sales, disclosed to Sellers during onboarding.
4. Prohibited items and conduct
You may not use the Platform to list or purchase illegal goods, counterfeit products, weapons, controlled substances, or any item prohibited by the laws of South Africa or the destination country. We reserve the right to remove listings and suspend accounts that violate this policy without prior notice.
5. Payments
Payments are processed by third-party payment providers (currently Flutterwave and PayFast). NILO.Africa does not store your full card details. By making a payment, you also agree to the terms of the payment provider processing that transaction.
6. Limitation of liability
To the maximum extent permitted by law, NILO.Africa is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, disputes between Buyers and Sellers, or the quality, safety, or legality of products listed by Sellers. Nothing in these Terms limits liability that cannot be excluded under South African law.
7. Disputes between Buyers and Sellers
If a problem arises with an order, Buyers and Sellers should first attempt to resolve it directly. NILO.Africa may, at its discretion, assist in mediating disputes but is not obligated to do so and does not guarantee a particular outcome.
8. Changes to these Terms
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
9. Governing law
These Terms are governed by the laws of South Africa. Any disputes not resolved informally shall be subject to the jurisdiction of the South African courts, without prejudice to any mandatory consumer protection rights you may have under the law of your own country of residence.
